1. SCOPE<\/h3>\n

Through this website we currently offer:<\/p>\n

    \n
  • Bicycle rental services<\/li>\n
  • Guided tours<\/li>\n
  • Self-guided tours<\/li>\n
  • Workshop appointment bookings (no online payment)<\/li>\n<\/ul>\n

    We do not currently sell physical goods online.
    \nIf and when goods are offered for sale, Section 8 of this policy will apply.<\/p>\n

    2. LEGAL RIGHT OF WITHDRAWAL (EU CONSUMER LAW)<\/h3>\n

    Under EU and Spanish consumer protection law, consumers purchasing services online generally have a 14-day right of withdrawal<\/strong>.<\/p>\n

    However, pursuant to Article 103(a) of Royal Legislative Decree 1\/2007<\/strong> and Article 16(l) of Directive 2011\/83\/EU<\/strong>, the right of withdrawal does not apply to:<\/p>\n

    Services related to leisure activities (such as tours, rentals, events) when the contract provides for a specific date or period of performance.<\/p><\/blockquote>\n

    Since our bicycle rentals and guided\/self-guided tours are booked for specific dates, the statutory 14-day withdrawal right does not apply once the booking is confirmed.<\/p>\n

    3. CANCELLATION POLICY \u2014 RENTALS & TOURS<\/h3>\n

    Although the statutory withdrawal right does not apply, Tossa Cycling voluntarily offers the following cancellation conditions:<\/p>\n

    3.1 Free Cancellation<\/h3>\n

    Cancellations made at least 8 days before<\/strong> the start date of the rental or tour
    \n\u2192 100% refund<\/strong><\/p>\n

    3.2 Late Cancellation<\/h3>\n

    Cancellations made 7 days or less before<\/strong> the start date
    \n\u2192 Refunds may not be granted<\/p>\n

    3.3 No-Show<\/h3>\n

    Failure to appear at the agreed date and time without prior notice
    \n\u2192 No refund<\/p>\n

    \n

    4. MODIFICATIONS<\/h3>\n

    We understand that travel plans may change.<\/p>\n

      \n
    • Date changes requested at least 8 days before<\/strong> the start date will be accommodated subject to availability.<\/li>\n
    • Changes requested later may incur administrative or availability limitations.<\/li>\n<\/ul>\n

      All modification requests must be submitted in writing to:<\/p>\n

      5. WEATHER CONDITIONS<\/h3>\n

      Our tours and rentals operate in outdoor environments.<\/p>\n

        \n
      • Mild or normal weather conditions do not justify cancellation.<\/li>\n
      • In case of severe or unsafe weather conditions (as determined by Tossa Cycling), we may:\n
          \n
        • Offer an alternative date, or<\/li>\n
        • Issue a partial or full refund at our discretion.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
          \n

          6. FORCE MAJEURE<\/h3>\n

          Tossa Cycling shall not be liable for cancellations or modifications due to events beyond reasonable control, including but not limited to:<\/p>\n

            \n
          • Natural disasters<\/li>\n
          • Government restrictions<\/li>\n
          • Public health emergencies<\/li>\n
          • Civil unrest<\/li>\n<\/ul>\n

            In such cases, we will attempt to offer rescheduling or credit where possible.<\/p>\n

            \n

            7. WORKSHOP APPOINTMENTS (NO ONLINE PAYMENT)<\/h3>\n

            Workshop bookings made via our appointment form do not involve online payment.<\/p>\n

              \n
            • Appointments may be cancelled or rescheduled by contacting us in advance.<\/li>\n
            • We reserve the right to refuse service in case of repeated no-shows.<\/li>\n<\/ul>\n
              \n

              8. FUTURE ONLINE SALE OF GOODS (NOT CURRENTLY ACTIVE)<\/h3>\n

              If physical goods are offered for sale in the future, the following will apply:<\/p>\n

              8.1 14-Day Right of Withdrawal<\/h3>\n

              Consumers will have the right to withdraw within 14 calendar days<\/strong> from the date of delivery.<\/p>\n

              8.2 Return Conditions<\/h3>\n

              Returned goods must:<\/p>\n

                \n
              • Be unused<\/li>\n
              • Be in original packaging<\/li>\n
              • Be in resalable condition<\/li>\n<\/ul>\n

                Return shipping costs may be borne by the customer unless the item is defective.<\/p>\n

                8.3 Defective or Incorrect Goods<\/h3>\n

                In case of defective or incorrect products:<\/p>\n

                • Customers must notify us within 48 hours of delivery.<\/li>\n
                • We will offer replacement, repair, or refund in accordance with EU consumer law.<\/li>\n<\/ul>\n

                  9. REFUND PROCESS<\/h3>\n

                  Approved refunds will be:<\/p>\n

                  • Processed using the original payment method<\/li>\n
                  • Completed within 14 days of confirmation<\/li>\n<\/ul>\n

                    We reserve the right to withhold refund until services are confirmed cancelled or, in the case of goods, until returned items are received (when applicable in the future).<\/p>\n

                    10. LIABILITY LIMITATION<\/h3>\n

                    Tossa Cycling shall not be liable for:<\/p>\n

                    • Indirect or consequential damages<\/li>\n
                    • Personal injury resulting from misuse of rental equipment<\/li>\n
                    • Loss of personal belongings during services<\/li>\n<\/ul>\n

                      Participants are responsible for ensuring they are medically fit to participate.<\/p>\n
