1. SCOPE

Through this website we currently offer:

  • Bicycle rental services
  • Guided tours
  • Self-guided tours
  • Workshop appointment bookings (no online payment)

We do not currently sell physical goods online.
If and when goods are offered for sale, Section 8 of this policy will apply.

2. LEGAL RIGHT OF WITHDRAWAL (EU CONSUMER LAW)

Under EU and Spanish consumer protection law, consumers purchasing services online generally have a 14-day right of withdrawal.

However, pursuant to Article 103(a) of Royal Legislative Decree 1/2007 and Article 16(l) of Directive 2011/83/EU, the right of withdrawal does not apply to:

Services related to leisure activities (such as tours, rentals, events) when the contract provides for a specific date or period of performance.

Since our bicycle rentals and guided/self-guided tours are booked for specific dates, the statutory 14-day withdrawal right does not apply once the booking is confirmed.

3. CANCELLATION POLICY — RENTALS & TOURS

Although the statutory withdrawal right does not apply, Tossa Cycling voluntarily offers the following cancellation conditions:

3.1 Free Cancellation

Cancellations made at least 8 days before the start date of the rental or tour
→ 100% refund

3.2 Late Cancellation

Cancellations made 7 days or less before the start date
→ Refunds may not be granted

3.3 No-Show

Failure to appear at the agreed date and time without prior notice
→ No refund

4. MODIFICATIONS

We understand that travel plans may change.

  • Date changes requested at least 8 days before the start date will be accommodated subject to availability.
  • Changes requested later may incur administrative or availability limitations.

5. WEATHER CONDITIONS

Our tours and rentals operate in outdoor environments.

  • Mild or normal weather conditions do not justify cancellation.
  • In case of severe or unsafe weather conditions (as determined by Tossa Cycling), we may:
    • Offer an alternative date, or
    • Issue a partial or full refund at our discretion.

6. FORCE MAJEURE

Tossa Cycling shall not be liable for cancellations or modifications due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Public health emergencies
  • Civil unrest

In such cases, we will attempt to offer rescheduling or credit where possible.

7. WORKSHOP APPOINTMENTS (NO ONLINE PAYMENT)

Workshop bookings made via our appointment form do not involve online payment.

  • Appointments may be cancelled or rescheduled by contacting us in advance.
  • We reserve the right to refuse service in case of repeated no-shows.

8. FUTURE ONLINE SALE OF GOODS (NOT CURRENTLY ACTIVE)

If physical goods are offered for sale in the future, the following will apply:

8.1 14-Day Right of Withdrawal

Consumers will have the right to withdraw within 14 calendar days from the date of delivery.

8.2 Return Conditions

Returned goods must:

  • Be unused
  • Be in original packaging
  • Be in resalable condition

Return shipping costs may be borne by the customer unless the item is defective.

8.3 Defective or Incorrect Goods

In case of defective or incorrect products:

  • Customers must notify us within 48 hours of delivery.
  • We will offer replacement, repair, or refund in accordance with EU consumer law.

9. REFUND PROCESS

Approved refunds will be:

  • Processed using the original payment method
  • Completed within 14 days of confirmation

We reserve the right to withhold refund until services are confirmed cancelled or, in the case of goods, until returned items are received (when applicable in the future).

10. LIABILITY LIMITATION

Tossa Cycling shall not be liable for:

  • Indirect or consequential damages
  • Personal injury resulting from misuse of rental equipment
  • Loss of personal belongings during services

Participants are responsible for ensuring they are medically fit to participate.
