1. SCOPE

Through this website we currently offer:

  • Bicycle rental services
  • Guided tours
  • Self-guided tours
  • Workshop appointment bookings (no online payment)

We do not currently sell physical goods online.
If and when goods are offered for sale, Section 8 of this policy will apply.

Which conditions apply. The general rental conditions (clauses R1 to R11, below) and Section 3 of this policy apply to bicycle rentals and guided day tours. Multi-day events and organised tours published with their own payment and cancellation schedule — including Tour de Girona and Gravel Odyssey Girona — are governed by the conditions published on the relevant event page, which prevail over Section 3 for those bookings. Where a single order contains both a standard rental and an event place, each item is governed by its own conditions.

GENERAL RENTAL CONDITIONS

R1. Tossa Cycling supplies the bicycle and equipment in good working order.

R2. The renter must inspect the bicycle before use and report any defect immediately. Tossa Cycling will repair or replace defective equipment, or refund the affected rental time.

R3. The renter is responsible for loss of or damage to the equipment caused by their own negligence or misuse, and for theft where the renter has not taken reasonable care. The renter is not responsible for fair wear and tear, mechanical failure, or anything attributable to Tossa Cycling.

R4. The renter must hold valid photographic identification, which is recorded on the contract.

R5. Tossa Cycling inspects all returned equipment, in the renter’s presence where possible.

R6. Pickup, return and scheduled handovers. Our shop opening hours and our rental handover times are not the same thing. Confirmed rentals are serviced by appointment, including outside shop hours.

  • Tuesday to Saturday — shop 10:00–13:00 and 16:00–20:00. Final return by 20:00.
  • Sunday — shop 10:00–13:00. Return at 20:00 sharp, scheduled handover.
  • Monday — shop closed. Pickup at 10:00 sharp and return at 20:00 sharp, scheduled handover.

Sunday evening and Monday handovers are appointments: a member of our staff attends specifically. No alternative times are routinely available.

Please arrive punctually. Our staff can wait a courtesy period of up to 15 minutes; this is not an alternative appointment time and continued attendance is not guaranteed. If you expect a delay, call +34 673 690 458.

Equipment must be handed to an authorised member of our staff. Bicycles must not be left unattended or returned without a handover unless we have expressly agreed otherwise in writing. Equipment left unattended remains your responsibility until we have received it.

Late return. After the courtesy period, and while a handover can still be received, a charge of 20% of the published daily rate for that bicycle applies for each commenced hour, capped at one additional day’s rental for that day.

Missed appointment. If the customer does not return the bicycle at the agreed appointment and staff are no longer available to receive it, the hourly charge does not apply: the bicycle must be returned at a newly agreed appointment and one additional rental day is charged at the published rate, and each further day likewise. The hourly charge and the additional day are never both charged for the same period. A telephone call after the agreed return time does not automatically extend the appointment or require our staff to return to the shop.

No charge applies where the delay is caused by an accident, by a mechanical failure of our equipment, by our own arrangements, or by another circumstance outside your control.

If we fail to attend a confirmed handover. Contact us immediately on +34 673 690 458 and follow our instructions. Pickup: if we do not deliver the bicycle at the agreed appointment, the rental has not begun; we will offer a replacement bicycle, an alternative time, or a full refund of the amount paid for the period not provided. Return: if we do not attend an agreed collection, no charge arises from our absence and the rental period is treated as ending at the scheduled time; please keep the equipment reasonably secure until we agree collection. None of this limits your statutory rights.

R7. Condition on return. The equipment must be returned in the condition supplied, fair wear and tear excepted. Where repair is needed as a result of clause R3, the renter is charged the actual cost of parts plus labour at our published workshop rate. For any charge above €50 we provide a documented estimate and notify the customer before carrying out the work, and replaced parts remain available for inspection. Ordinary punctures sustained in normal riding are included in the rental and are not charged. Charges apply where damage results from demonstrable misuse: riding terrain the bicycle was not hired for, continuing on a flat tyre, impact damage, or damage from transporting the bicycle other than as agreed.

R8. Early return. Voluntary early return does not entitle the renter to a refund of unused rental time; the full agreed price remains payable. See section 3.4.

R9. Cancellations. Governed by section 3 of this policy. Multi-day events published with their own cancellation schedule are governed by that schedule.

R10. Helmets. Tossa Cycling provides a helmet on request and requires a helmet to be worn on all guided tours. Riders must also comply with the helmet requirements of Spanish traffic law, which differ for minors, for interurban roads and for urban areas.

R11. These are the general conditions governing bicycle rentals at Tossa Cycling.

2. LEGAL RIGHT OF WITHDRAWAL (EU CONSUMER LAW)

Under EU and Spanish consumer protection law, consumers purchasing services online generally have a 14-day right of withdrawal.

However, pursuant to Article 103(l) of Royal Legislative Decree 1/2007 and Article 16(l) of Directive 2011/83/EU, the right of withdrawal does not apply to:

Services related to leisure activities (such as tours, rentals, events) when the contract provides for a specific date or period of performance.

Since our bicycle rentals and guided/self-guided tours are booked for specific dates, the statutory 14-day withdrawal right does not apply once the booking is confirmed.

3. CANCELLATION POLICY — RENTALS & TOURS

Although the statutory withdrawal right does not apply, Tossa Cycling voluntarily offers the following cancellation conditions:

3.1 Free Cancellation

Cancellations made at least 8 days before the start date of the rental or tour
→ 100% refund

3.2 Late cancellation

Cancellations received on the 7th calendar day before the start date or later → are not refundable. Tossa Cycling may, at its discretion, offer a date change or a credit subject to availability. This does not limit refunds required by applicable law, refunds due where we fail to meet our own service obligations, or those provided for in sections 3.4, 5 or 6.

How the deadline is calculated. The deadline is calculated as the difference between the calendar date of cancellation and the calendar date on which the service begins, using Spanish local time. The time of day does not affect the calculation.
Examples, for a rental starting Saturday 18 July: cancelled Friday 10 July → 8 days → full refund. Cancelled Saturday 11 July → 7 days → not refundable. Cancelled Friday 10 July at 23:50 → still 8 days → full refund; the hour does not matter.

3.3 No-Show

Failure to appear at the agreed date and time without prior notice
→ No refund

3.4 Early return

If the customer voluntarily returns the bicycle before the end of the agreed rental period, unused rental days or hours are not refunded and the full agreed rental price remains payable. This does not affect the customer’s statutory rights, nor any refund due where the equipment is defective, where Tossa Cycling does not provide the agreed service, or where a refund is required by applicable law. Tossa Cycling may offer a partial refund or credit at its discretion; doing so in one case creates no entitlement in another.

4. MODIFICATIONS

We understand that travel plans may change.

  • Date changes requested at least 8 days before the start date will be accommodated subject to availability.
  • Changes requested later may incur administrative or availability limitations.

All modification requests must be submitted in writing to:

info@tossacycling.com

5. WEATHER CONDITIONS

Our tours and rentals operate in outdoor environments.

  • Mild or normal weather conditions do not justify cancellation.
  • In case of severe or unsafe weather conditions (as determined by Tossa Cycling), we may:
    • Offer an alternative date, or
    • Issue a partial or full refund at our discretion.

6. FORCE MAJEURE

Tossa Cycling shall not be liable for cancellations or modifications due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Public health emergencies
  • Civil unrest

In such cases, we will attempt to offer rescheduling or credit where possible.

7. WORKSHOP APPOINTMENTS (NO ONLINE PAYMENT)

Workshop bookings made via our appointment form do not involve online payment.

  • Appointments may be cancelled or rescheduled by contacting us in advance.
  • We reserve the right to refuse service in case of repeated no-shows.

8. FUTURE ONLINE SALE OF GOODS (NOT CURRENTLY ACTIVE)

We do not currently sell physical goods through this website. If goods are offered in the future, the sale will be governed in full by applicable statutory withdrawal, warranty and consumer-protection requirements, and the specific conditions will be published at that time. Nothing in this policy restricts rights granted to consumers by law.

This section does not affect the bicycle rental cancellation policy, which is set out in section 3.

9. REFUND PROCESS

Approved refunds will be:

  • Processed using the original payment method
  • Completed within 14 days of confirmation

We reserve the right to withhold refund until services are confirmed cancelled or, in the case of goods, until returned items are received (when applicable in the future).

10. LIABILITY LIMITATION

The customer is responsible for damage to the bicycle caused by their own negligence or misuse, in accordance with clause R3.

Tossa Cycling is responsible for defective equipment and for problems attributable to our own negligence, and will compensate the customer to the extent applicable law requires.

Customers’ personal belongings remain their own responsibility, unless loss or damage is attributable to Tossa Cycling.

Customers should be in adequate physical condition for the activity booked and should tell us of any relevant circumstance.

Nothing in this policy limits or excludes the rights granted to consumers by law, or Tossa Cycling’s liability in cases where the law does not permit it to be excluded.
